Anticipatory bail application entertained at lightening speed – Advocates Association expresses grave concern

Bengaluru, March 8: The Advocates Association, Bangalore has expressed grave concern over the High Court’s decision to entertain the anticipatory bail application of BJP MLA Madal Virupakshappa ‘at a lightening speed’
In a letter addressed to Chief Justice of India, Justice D.Y. Chandrachud, association president Vivek Subba Reddy said that the bail application of ordinary common man is not taken up for several weeks or months but in the case of this corruption-accused MLA, the Karnataka High Court considered his application overnight.

“Such incidents will shake the common man’s faith in the judiciary. Even a MLA must treated as a common man because all are equal in the eyes of law,” Vivek Subba Reddy stated in his letter.
It may be recalled that the Karnataka High Court has granted interim anticipatory bail within 24 hours of filing the petition to Madal Virupakshappa who is accused in the multi-crore scam being investigated by the Lok Ayuktha.


A total of Rs 6 crores was seized from his residence apart from Rs 81 lakhs from his son’s residence recently. Since then, Madal Virupakshappa has remained untraceable.
Vivek Subba Reddy has further appealed to the Chief Justice of India to direct the Karnataka High Court to either treat all the petitions especially bail applications “in a similar lightening speed” or reverse the order of giving anticipatory bail to the corruption-accused.
“If MLAs application can receive preferential treatment, then an ordinary common man also should be given the same privilege,” Vivek Subba Reddy stated.
He further said that in the temple of justice every one should get equal and similar treatment. “But we the memvers of the Advocates Association are shocked and concerned over this gross preferential treatment given to a MLA accused in a corruption case,” Vivek Subba Reddy added.
